Commissioners oppose Polk County Appraisal budget

 

LIVINGSTON — After much discussion with the Polk County District Attorney and the Leggett ISD Superintendent, Polk County Commissioners voted to disperse funds from the permanent school fund to Leggett and Big Sandy ISD and voted to oppose the proposed budget from the Polk County Appraisal District during Tuesday's meeting. District Attorney Lee Hon told commissioners he and County Auditor Ray Stelly had concerns about the adequacy of the resolution passed by the Leggett ISD board of trustees. Hon said Stelly could not be present for Tuesday's meeting because his wife had a doctor's appointment, but both had expressed concerns about vague language in the resolution that was not cleared up in later communication with Superintendent Jim Wise. Wise countered that Goodrich's resolution, which previously had been accepted by the court, was no more specifi c. But during the court's deliberations, Hon pointed out that Goodrich ISD's resolution stated they may use the funds for roof repairs, the purchase of real property or other constitutionally permissible uses. In followup conversations, Dr. Guylene Robertson gave Stelly information on a few courses of action the district plans to follow. They will narrow their options down in the near future. There is no defi nitive plan on how Leggett planned to spend the money. In later conversations they offered no further information. Wise responded that initially the board said they wanted to buy a bus. "We had a board member that was very pushy. He insisted for me to get that approved. When that was rejected I asked Mr. Hon to put that in writing so I could show the board and he said no," Wise said. Hon later explained that he couldn't put his legal opinion in writing because he doesn't represent Leggett ISD, Hon represents Polk County and he suggested that Leggett ISD consult its own attorney. "This body has a fi duciary duty to the county and the students of this county and you have the ability to approve or disapprove each specifi c project if you want to take it that far. I don't think it's unreasonable to have some articulable plan for the funds before they are dispersed," Hon said. Pct. 2 Commissioner then asked Wise if it really mattered if the money sat in an interestbearing investment account maintained by the county or an interest-bearing account maintained by Leggett ISD. "I don't know that it makes a difference other than it makes a difference to our people that it's our money. It has been ruled by the attorney general that it can be invested, and draw interest, before they use it. They'd like to know the money is there. The county can audit us. We'll let them know the money would not be spent for something unconstitutional. Purvis made a motion and Pct. 4 Commissioner Tommy Overstreet seconded to disperse the money to Leggett ISD. The motion passed unanimously. Purvis also made a motion to oppose the Polk County Appraisal District budget, which was seconded by Pct. 1 Commissioner Bob Willis. The motion passed with Purvis, Overstreet and Willis voting for; Vincent and Thompson voted against The County Judge will send a letter to the appraisal district notifying them that the county has rejected their proposed budget. Commissioners also unanimously approved a capital purchase request in the amount of $2,500 for a financial system software upgrade for the county auditor, county treasurer and human resources departments to be paid from the general fund balance and included on the FY 2013 reimbursement resolution. Commissioners also approved the following routine items on the consent agenda: • Listing of previously authorized capital purchases to be included on reimbursement resolution; • Authorize Veterans Service Officer to attend the Texas Veterans Commission 2013 Spring Training Conference in San Antonio. • Approve appointment of Lowell Crew as presiding judge of County Election Precinct Voting Box 6 for the May 11, 2013 Election. • Approve April 19, 2013, termination of Indigent Health Care mandated medical provider appointment of Dr. F. Edward Waechter, due to physician's retirement. • Approve memorandum of understanding for joint use of existing radio equipment between the sheriff's department and South Polk County Volunteer Fire Department
