Babysitter pleads guilty to charges

LIVINGSTON — Assistant District Attorney Beverly Armstrong said Monday, April 29 that a plea agreement has been reached with Jonathan Wayne Bryan,20, of Seven Oaks, in connection with an indictment for two counts of aggravated sexual assault of a child and a third count of indecency with a child by contact. Bryan will serve 30 years in the Texas Department of Criminal Justice for the two Aggravated Sexual Assault charges and 10 years for indecency. The sentences will run concurrently. Armstrong said the charges stem from an incident that occurred around Aug. 17, 2012 when Bryan and his girlfriend Amanda Fuller were babysitting the 5-year-old female victim. She later made an outcry that Bryan had been having sex with her. During a forensic interview at Childrenz Haven, the Polk County Child Advocacy Center, the victim said the defendant "put his weiner in her mouth," which resulted in one count of the indictment charging him with oral sexual contact. Bryan confessed to that incident, Armstrong said. The victim also described a second incident during the forensic interview during which the 5-year-old used child-like terms to describe sexual intercourse. "She described the second incident as 'Jonathan's pee-pee touched her pee-pee on the inside'," Armstrong said. In a third incident, Bryan exposed himself to the victim. The defendant gave a statement to investigators at the Polk County Sheriff's Offi ce and confessed to putting his penis in the victim's mount, but denied penetration. During a physical examination, a specially trained Sex Assault Nurse Examiner found evidence of trauma that was described as a "notch" and "ridge" during the pelvic exam. If Bryan is released on parole after serving a minimum of half of his sentence he will be required to register as a sex offender for the rest of his life, Armstrong said
