Judge Denies Probation for Doc’s Country Store Robber

After a contested hearing at the Houston County Courthouse on Thursday, May 22, Judge Pam Foster Fletcher denied a Palestine man’s request to be released from prison on probation.
DeArthur Pinson Jr., 23, of Palestine, was sentenced to 10 years in prison in November 2007 for a February 2006 aggravated robbery at the Doc’s Country Store between Crockett and Latexo.
Texas criminal law allows a defendant to file a motion to impose community supervision, or probation, when a judge sentences a defendant to 10 years or less in Texas Department of Corrections.
His defense attorney, Rusk lawyer Daphne Session, filed a motion asking that he be released from prison on probation.
Testifying on his behalf at
the hearing on that motion were his mother and sister.
The motion was opposed by Houston County District Attorney David E. Cervantes, who called as witnesses the victim of the robbery, Jessica Zwar; the victim’s mother, Lisa Zwar; and Department of Public Safety Trooper Bob Reeves.
