TxDOT adopts “Cell Phone Use Prohibited – Up to $200 Fine” sign
Houston County Courier - August 2009
LUFKIN - To implement the requirements of House Bill 55, from the 81st Legislature, the Texas Department of Transportation (TxDOT) has adopted the “Cell Phone Use Prohibited – Up to $200 Fine” sign.
The law, as worded below, on HB 55 becomes effective Sept. 1.
"A municipality, county, or other political subdivision that enforces this section shall post a sign that complies with the standards described by this subsection at the entrance to each school crossing zone in the municipality, county, or other political subdivision.”
The law also states “This section preempts all local ordinances, rules, or regulations that are inconsistent with specific provisions of this section adopted by a political subdivision of this state relating to the use of a wireless communication device by the operator of a motor vehicle,”
The city of Crockett indicated in a recent city council meeting that they intend to enforce the law inside the city limits.
The county has not taken action on the measure since school districts are primarily located within the boundaries of individual municipalities.
