Reports on fatal fire to go to grand jury

LIVINGSTON — Investigative reports from several outside agencies into the deaths of three Livingston children in a house fi re in December at 1019 Brock Street are fi nally complete, according to Livingston police offi cials. LPD spokesman Lt. Matt Parish said autopsy reports from the medical examiner in Jefferson County showed Vanessa Soto, 2, Kyle Soto, 4, and Julian (Jack) Smith, 4, died of smoke inhalation. That report along with investigations by Livingston Fire Marshal Mark Taylor, the State Fire Marshal’s Offi ce, and Houston Fire Department arson investigators turned up no signs of anything other than an accidental fi re, Parish said. Those reports will be forwarded to Polk County District Attorney Lee Hon. “It is standard procedure for this department to forward our investigation into any death in a fi re or car crash to the district attorney’s office,” Parish said. “Lee Hon typically presents those to the grand jury for review just to ensure that we have thoroughly explored every option in an accidental death.” About 20 members of the Livingston Volunteer Fire Department were called after the mobile home was fully involved in fl ames on Dec. 21. Lisa Marie Smith, the only adult at home at the time, suffered smoke inhalation and other injuries while attempting to get the children out of the house.
