LEGAL NOTICE

                  Advertisement and Invitation for Bids

      The County of Polk will receive bids for the Flood Disaster Relief Grant Project ORCA Contract No. 727147 until 10:00 A.M. (CST), May 1, 2008, at County Judges Office, Polk County Courthouse, 101 West Church Street, Suite 300, Livingston, Texas 77351. The bids will then be publicly opened and read aloud.

      Bids are invited for several items and quantities of work as follows: Construction of Roadway and Drainage Improvements for Swick Trail in Big Thicket Lake Estates Area for a length of approximately 3,500 linear feet, including reshaping and compaction of road, select fill, stabilization, asphaltic surface treatment, driveway turnouts and culvert replacement.

    Bid/Contract Documents, including Drawings and Technical Specifications are on file at Goodwin-Lasiter, Inc., 1609 S. Chestnut, Suite 202, Lufkin, Texas 75901, 936-637-4900 (at which specifications can be obtained).

    Copies of the Bid/Contract Documents may be obtained for $65.00 (non-refundable) with the Engineer for each set of documents obtained.

    A Bid bond in the amount of 5% of the bid issued by an acceptable surety shall be submitted with each bid. A certified check or bank draft payable to the County of Polk or negotiable U.S. Government Bonds (at par value) may be submitted in lieu of the Bid Bond. Cash currency is not acceptable as bid surety and is not to be submitted in lieu of the Bid Bond.

   Attention is called to the fact that not less than the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Office of Rural Community Affairs (ORCA) and contained in the contract documents, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, age or national origin.

   The County of Polk reserves the right to reject any or all bids or to waive any informalities in the bidding.

   Bids may be held by the County of Polk for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidder’s qualifications prior to the contract award. County of Polk, John P. Thompson, County Judge, March 2008.

    NOTICE TO DEFENDANT: “You have been sued. You may employ an attorney.     The names of the parties to the cause are as follows: CYNTHIA JEAN COSNER is Plaintiff and THE HEIRS AND UNKNOWN HEIRS OD CHARLENE LENA MITCHELL, DECEASED, JOHN CALDWELL COOGLER, DECEASED AND MARY ANN COOGLER MITCHELL, DECEASED are Defendants.

   This is a suit to partition the property described as follows, to-wit: 0.360 acre of land, more or less, in the M.L. Choate Survey, A-15, Polk County, Texas, and being the same as those tracts conveyed by Ray R. Marsh to J.C. Coogler and wife, Charlie Coogler, by deeds recorded at Volume 157, Page 26 in Volume 254, Page 111 of the Deed Records of Polk County, Texas.

   The officer executing this writ shall promptly serve the same according to requirements of law, and the mandates thereof, and make due return as the law directs.
