2 brothers charged with deadly conduct

TRINITY – Two brothers were charged with deadly conduct Saturday following an incident involving a shotgun in the Lakewood at Livingston subdivision east of Trinity. Walter Overbeck, 55, and Rodney Overbeck, 52, were being held this week under $10,000 bonds after each was charged with the Class A misdemeanor of deadly conduct. They also were charged with the Class C misdemeanor of public intoxication and were each assessed a $355 fine. According to Pct. 1 Constable Woody Wallace, he and deputy constables Ricky Hope and Rusty Barrett responded to a call for help from residents of the Lakewood subdivision and found one of the brothers waiving a 12 gauge shotgun. “Once we arrived, we were able to disarm them and they surrendered without further incident,” Wallace said. According to witness statements, the incident began when a new family began moving into a residence next door to the Overbeck’s home in the subdivision. Wallace said an argument developed that escalated into blows being thrown over a fence separating the two properties. “One of the brothers went into their house and came out with the shotgun,” Wallace said. The suspect is alleged to have pointed the weapon at eight people standing near the property and at one point leveled the loaded weapon at a woman’s head and pumped a shell into the shotgun’s chamber. “While he was doing that, his brother was off to the side yelling, ‘shoot ‘em, shoot ‘em’,” Wallace said.
