LVFD items on court agenda

A couple of items dealing with the Livingston Volunteer Fire Department are on the agenda for the regular meeting of the Polk County Commissioners Court at 10 a.m. Tuesday.

 

The Court will discuss and take action relating to a special warranty deed conveying to the City of Livingston, Texas the real property on which Fire Station No. 1 is situated, and authorizing the county judge to execute the deed and all documents necessary to complete the conveyance.

 

Additionally, the Court will discuss and take any action relating to the conveyance to Livingston Volunteer Fire Department Inc. of approximately 17.896 acres of the fireman’s training field property, being the portion of the 21.25-acre tract lying north of the U.S. Highway 190 right-of-way, including approval of a special warranty deed and authorization for the county judge to execute the deed and all documents necessary to complete the conveyance.

 

An agreement with the law firm of Linebarger, Goggan, Blair & Sampson LLP to act as special counsel to perform all legal services necessary to collect delinquent taxes as provided for in the Texas Property Tax Code and to authorize the county judge to execute such agreement will be considered for approval.

 A request from the Precinct 3 commissioner for exemption from Polk County mobile home park regulations to permit three mobile homes on personal property for private use, per affidavit from landowner, will be discussed and considered for approval.

 

Action relating to the Precinct 3 constable’s request to approve an interlocal agreement with Corrigan-Camden Independent School District for a school resource officer will be considered.

 

An interlocal agreement between Polk County and Angelina County for the housing of Polk County inmates, providing for 46 reserved beds at a rate of $75.00 per inmate per day for a six-month term at a minimum cost of $621,000, will be discussed and considered.

 The Court will consider requests for capital purchases to be paid from general fund balance and included on the fiscal year 2027 reimbursement resolution for year-end issuance of legally authorized debt, specifically, one 80-gallon steam kettle and three natural gas ovens for the Polk County Jail in the amount of $55,514.

 

Action relating to the proposals submitted in response to request for proposals #2026-19, prepositioned contracts for disaster debris removal, including ranking of proposers and authorization to negotiate with the highest-ranked proposers, will be considered.

 

The Court will also consider approval, approval upon conditions met, or rejection of the subdivision application for Burton & Burton Properties Subdivision No. 1 in Precinct 4.

 

In personnel matters, the Court will consider action on personnel action form requests submitted by department heads since last meeting, review any authorized emergency hires and consider action on the district attorney’s request for payment of FLSA comp time accrued by Katrina Brittain and Megan Knighton, to be paid from the district attorney salary line item.

 

Fiscal year 2026 budget revisions and amendments, as presented by the county auditor’s office, will be considered for approval.

 

During informational reports, the Court will issue a proclamation recognizing September as Suicide Prevention Awareness Month.

 

Items on the consent agenda include:

  • Approve minutes of the Aug. 25 regular meeting;
  • Approve schedules of bills;
  • Approve order designating surplus property;
  • Receive and record personnel action forms submitted by elected officials since the last meeting;
  • Approve Precinct 2 Constable Bill Cunningham’s request to appoint Robert Filio and Mohammed Abdulhameed Nehad as reserve deputy constables;
  • Approve order setting juror reimbursement for fiscal year 2027;
  • Receive and record order of general election to be held Nov. 3;
  • Approve early voting schedule for the Nov. 3 election, as requested by the county clerk;
  • Accept unclaimed property capital credits from the state comptroller of public accounts in the amount of $2,592.74, pursuant to Texas Local Government Code Section 381.004;
  • Accept 2027 retiree plan rates (TLIC Medical and Retiree RxCare prescription coverages) from Texas Association of Counties, Silver Choice;
  • Accept donation of antenna for the amateur radio system at the Polk County Emergency Operations Center;
  • Accept grant award in the amount of $49,369 for district attorney victim coordinator and liaison grant program for 2027-2028 and authorize the county judge to execute Contract Number C-00928 with the office of the attorney general.
