Commission spars over subdivision rules

COLDSPRING — While the San Jacinto County Commissioners Court passed some minor changes to the county subdivision regulations, questions arose over the timing of the requests.

Commissioner Crystal Dominy had asked for some minor changes to the language of certain provisions, but County Judge Fritz Faulkner pointed out that the recently formed subdivision committee hasn’t had its first meeting, and it seemed inappropriate to make changes.

However, Dominy pointed out that the county is in the midst of a development boom, and in certain areas, the court can’t wait a year for the committee to go through the rules.

She said that as far as county roads go, she needs help and was asking the commission to approve a change to require developers to add material to existing county roads to handle the increased traffic.

County Engineer Mark Wood said there also is a problem that the county doesn’t inspect what it requires.

In the meantime, the court approved changing a phrase in the rules that states the county shall take possession of roads built in a new development to the county may take possession of roads built in a new development. Faulkner and Commissioner Luke Sweeney opposed the measure.

“We’ve had these rules for years,” Faulkner said. “This new committee has not met yet, but we’re making changes. Every time someone goes to a seminar we have to make changes.”

A request to require developers to add material to strengthen existing county roads was tabled to discuss legal ramifications, with Dominy opposing the measure. Additionally, no action was taken on a requirement for developers to pay the county for outside engineering services at time of final plat approval, as such a requirement already existed.

In other business, commissioners:

  • took no action on hiring anyone to collect delinquent hotel/motel taxes from AirBNB rentals;
  • approved the use of the Courthouse Square for the third annual War Rally fundraiser for Harvest Reach International;
  • approved the use of Brookswater and Co. for the annual audit;
  • approved seeking bids for a well project for PB≻
  • tabled plat approval for Ponderosa Estates subdivision;
  • approved a preliminary plat for the Olde Oaks subdivision;
  • approved an application for a solid waste grant from DETCOG to hold a project for county cleanup;
  • approved an agreement with Liberty County for drug enforcement work; and
  • approved the estray livestock fee schedule.
