A couple of items dealing with the Livingston Volunteer Fire Department were acted on by the Polk County Commissioners Court during its regular meeting Tuesday. Though the Court approved a request from the Livingston Volunteer Fire Department to convey certain county-owned real property on Feb. 10 of this year, it took time to review and revise the contracts.

The request is for the conveyance of a portion of Block 1 underlying Fire Station No. 1 to the City of Livingston and approximately 17.896 acres of the fireman’s training field property (the portion of the 21.25-acre tract located north of the U.S. 190 right-of-way) to the Livingston Volunteer Fire Department.

The request was submitted by the department in anticipation of future operational needs and potential facility expansion. With continued population growth within the city and county, along with increased call volume, the city may eventually transition from a volunteer fire department to a paid department.

The Court approved special warranty deeds conveying the properties and authorized the county judge to execute the deed and all documents necessary to complete the conveyances.

An agreement with the law firm of Linebarger, Goggan, Blair & Sampson LLP to act as special counsel to perform all legal services necessary to collect delinquent taxes as provided for in the Texas Property Tax Code and to authorize the county judge to execute such agreement was approved.

 A request from the Precinct 3 commissioner for exemption from Polk County mobile home park regulations to permit three mobile homes on personal property for private use, per affidavit from landowner, was approved.

The Precinct 3 constable’s request to approve an interlocal agreement with Corrigan-Camden Independent School District for a school resource officer was approved.

An interlocal agreement between Polk County and Angelina County for the housing of Polk County inmates, providing for 46 reserved beds at a rate of $75.00 per inmate per day for a six-month term at a minimum cost of $621,000, was approved.

 The Court approved a request for capital purchase to be paid from general fund balance and included on the fiscal year 2027 reimbursement resolution for year-end issuance of legally authorized debt, specifically, one 80-gallon steam kettle and three natural gas ovens for the Polk County Jail in the amount of $55,514.

Action was taken in response to the request for proposals #2026-19, prepositioned contracts for disaster debris removal, including ranking of proposers and authorization to negotiate with the highest-ranked proposers. The Court approved DRC Emergency Services, which received the highest ranking score, and also approved JWTC as the secondary contractor.

The Court granted conditional approval to the subdivision application for Burton & Burton Properties Subdivision No. 1 in Precinct 4.

In personnel matters, the Court approved personnel action form requests submitted by department heads since the last meeting, review an authorized emergency hire in the maintenance department and approved the district attorney’s request for payment of FLSA comp time accrued by Katrina Brittain and Megan Knighton, to be paid from the district attorney salary line item.

Fiscal year 2026 budget revisions and amendments, as presented by the county auditor’s office, were approved.

During informational reports, the Court issued a proclamation recognizing September as Suicide Prevention Awareness Month.

Items on the consent agenda included:

  • Approval of the minutes of the Aug. 25 regular meeting;
  • Approval of the schedules of bills;
  • Approval of an order designating surplus property;
  • Receiving and recording personnel action forms submitted by elected officials since the last meeting;
  • Approval of Precinct 2 Constable Bill Cunningham’s request to appoint Robert Filio and Mohammed Abdulhameed Nehad as reserve deputy constables;
  • Approval of an order setting juror reimbursement for fiscal year 2027;
  • Receiving and recording order of general election to be held Nov. 3;
  • Approving the early voting schedule for the Nov. 3 election, as requested by the county clerk;
  • Accepting unclaimed property capital credits from the state comptroller of public accounts in the amount of $2,592.74, pursuant to Texas Local Government Code Section 381.004;
  • Accepting 2027 retiree plan rates (TLIC Medical and Retiree RxCare prescription coverages) from Texas Association of Counties, Silver Choice;
  • Accepting the donation of an antenna for the amateur radio system at the Polk County Emergency Operations Center; and
  • Accepting a grant award in the amount of $49,369 for district attorney victim coordinator and liaison grant program for 2027-2028 and authorize the county judge to execute Contract Number C-00928 with the office of the attorney general.
